We at Komobile, Inc. (hereinafter referred to as the ‘Komobile’) will handle all user information concerned with the Komobile’s TTtalk service and all its related services (hereinafter referred to collectively as the ‘Service’) in accordance with the following.
1. Collection of Information
Komobile shall use and acquire user information & usage information in the following ways:
Komobile collects the following information when the user creates new account to provide the service.
User’s Mobile phone number, Mobile device identification number (Device ID or IMEI), Phone-book stored on the device, Legal guardian information (if the user is not at least 14 years old).
Komobile may collect the following usage information while the user uses the service or the usage data is processed.
User’s log and contact data, cookie, contact IP information, status information, name, photo, time of visit, duration of use, unauthorized usage records, and other related information.
Komobile may collect the user’s information in the following methods.
User’s registration, Customer service, Promotional events, Using tools (cookie, information collection programs in device/server)
Komobile shall not collect the sensitive private information which can infringe the basic human right.
Race, National origin, Creed, Sexual orientation, Criminal record, Social status, Health status, Political orientation, etc.;
2. Purpose of User Information
Regarding the scope of usage, if usage rules and limitations have already been determined upon collection of a particular set of user information, as is the case concerning the use of phone-book data, the information concerned shall only be used in accordance with the scope of that particular function. For all other cases, Komobile shall use the acquired personal information for the following purposes listed below:
•to find people who the user knows, or may know and recommend or register them as friends
•to prevent any unauthorized use of the Service
•to offer an undisturbed and smooth Service to users
•to aggregate statistical data regarding the Service
•to conduct research and analysis aimed at reviewing and improving Services
•to enable Komobile to deal effectively with user inquiries
•to provide information regarding the Service etc., as well as advertising information from our partner businesses
•to provide new future developments regarding the Service
•to draw winners for promotional events, courier gifts to those winners, and to deliver purchased products, etc.
•to perform identity checks when a user makes an inquiry etc.
•to process claims relating to purchased items and paid services
•to notify users of any other important information regarding the Service and to contact users where necessary
3. Disclosure to Third Parties
Provision of Information
Komobile will never provide user information to any third parties expect under the following circumstances:
•when the user personally agrees to such provisions in advance
•when the law requires Komobile to do so
•when Komobile finds sufficient enough reasons to believe that the user is violating the Terms of Service and Komobile is forced to disclose the user's personal information in order to protect Komobile's rights, properties, and/or services
•when it is necessary for the protection of a person's life, body, or property, and at such a time, when obtaining the user's prior consent is difficult
•when it is especially necessary for the improvement of public health or to promote the sound growth of children, and at such a time, when obtaining the user's prior consent is difficult
•when Komobile is required to cooperate with a state institution, a local government, or an individual or a business operator entrusted by one in executing the affairs prescribed by laws and regulations, and at such a time, when obtaining the users prior consent could impede the aims of the authorities
•in cases where the user's personal information is revealed as a result of the succession of Komobile's business in a merger, demerger, or business transfer, etc.
Shared Use of Information
Komobile may share the user's personal information with a business partner, when a business partner's cooperation is needed in order to keep providing the Service to the user.
In such circumstances, Komobile will inform the user regarding the purpose of information sharing, the name of the business partner and information manager, as well as the type of shared information involved before sharing the user’s personal information with such a business partner.
4. Protection and User Rights of Information
Komobile takes precautions to safeguard your personal information against loss, theft and misuse, as well as against unauthorised access, disclosure, alteration and destruction. However, no data transmission over the Internet or other network can be guaranteed to be 100% secure. As a result, while we strive to protect information transmitted on or through the Service, we cannot and do not guarantee the security of any information you transmit on or through the Service, and you do so at your own risk.
Users may, at any time, confirm or correct their registered personal information. Users can also delete their accounts.
Users may, through the procedures determined by Komobile, send Komobile a request for the disclosure of personal information which the users cannot confirm/access via the Service. Komobile may decline to process requests that are unreasonably repetitive, require disproportionate technical effort, jeopardise the privacy of others, are extremely impractical or for which access is not otherwise required by local law.
The users can choose freely whether or not they will provide Komobile with their personal information, however the users may be unable to use a part of the Service until they have provided Komobile with the necessary information.
Upon withdrawing from our Services, when a user account is deleted, all user information will be disposed of in the correct manner in accordance with the law and Komobile regulations.
5. Children’s Privacy
We do not knowingly collect Personal Information from children under the age of 14. By using our Service, you acknowledge that you are at least 14 years old.Users younger than 14 years of age must obtain consent from their parents or legal representatives before they provide any personal information In order to use the Service.
